2. Refund Eligibility

Refunds may be considered under the following circumstances:

  • Services not delivered as specified in the project agreement
  • Material failure to meet agreed-upon project milestones
  • Cancellation within the cooling-off period (14 days from contract signing)

3. Non-Refundable Items

  • Services already rendered and accepted by the client
  • Third-party software licenses or subscriptions purchased on behalf of the client
  • Work completed during the discovery and planning phases that has been approved

2. Service Description

AtlasHarborForge provides custom digital engineering services including but not limited to web development, system architecture, API integration, and digital transformation consulting. The specific scope, deliverables, and timelines for each engagement are defined in individual project agreements.

3. Intellectual Property

Upon full payment of all applicable fees, the client shall retain ownership of all custom code, designs, and documentation created specifically for their project. AtlasHarborForge retains the right to use general methodologies, frameworks, and non-proprietary knowledge gained during the engagement.

4. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information shared during the course of the engagement. This obligation survives the termination of the service agreement for a period of three (3) years.

5. Limitation of Liability

To the maximum extent permitted by applicable law, AtlasHarborForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of Santander, Spain.
